The law amends the 2003 Equal Pay Act, which made it illegal to pay employees differently based o<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-461\" src=\"https:\/\/marcusboxerman.com\/blog\/wp-content\/uploads\/2019\/03\/qigdiczuae6tk4vhrf3d.jpg\" alt=\"qigdiczuae6tk4vhrf3d\" width=\"256\" height=\"256\" srcset=\"https:\/\/marcusboxerman.com\/blog\/wp-content\/uploads\/2019\/03\/qigdiczuae6tk4vhrf3d.jpg 256w, https:\/\/marcusboxerman.com\/blog\/wp-content\/uploads\/2019\/03\/qigdiczuae6tk4vhrf3d-150x150.jpg 150w\" sizes=\"auto, (max-width: 256px) 100vw, 256px\" \/>n their sex or race.<\/p>\n<p style=\"text-align: left;\">Specifically, the law prohibits employers from:<\/p>\n<ul style=\"text-align: left;\">\n<li>Asking job applicants about their salary history;<\/li>\n<li>Seeking salary history information from applicants\u2019 previous employers; and<\/li>\n<li>Requiring employees to sign contracts or waivers that prohibit them from discussing compensation\u00a0with other employees.<\/li>\n<\/ul>\n<p style=\"text-align: left;\">Any employer who violates the new law may face civil action by their employees to recover lost wages, compensatory damages, special damages (up to $10,000), punitive damage, injunctive relief, and attorney\u2019s fees. Additionally, employers who violate the law are subject to civil penalties of up to $5,000 for \u201ceach violation for each employee affected.\u201d<\/p>\n<p>The law does not prohibit:<\/p>\n<ul style=\"text-align: left;\">\n<li>Employees from willingly disclosing their salary history with their employer; however, the employer may not consider that information when making decisions about employment or compensation;<\/li>\n<li>Employees from discussing their wages and benefits with each other; and<\/li>\n<li>Employers from providing applicants with information about the compensation of the position or discussing applicant expectations about the wages, benefits, compensation, or salary of the position.<\/li>\n<\/ul>\n<p style=\"text-align: left;\">Before the new law goes into effect on September 29, 2019, employers should:<\/p>\n<ul style=\"text-align: left;\">\n<li>Review employee handbooks, employment agreements, and other documents to remove any prohibitions about discussing compensation\u00a0with other employees; and<\/li>\n<li>Review application forms and hiring processes to ensure that the forms and processes have no questions regarding salary history.<\/li>\n<\/ul>\n<p style=\"text-align: left;\">If you have any questions about the new law or need assistance reviewing your employment materials, please contact Marcus &amp; Boxerman at (312) 216-2720 or <a href=\"mailto:info@marcusboxerman.com\">firm@marcusboxerman.com<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The No Salary History law, which takes effect\u00a0September 29, 2019, prohibits Illinois employers from asking job applicants about their salary history.
